THE CNEL INFORMATION NOTE ON THE FILED NATIONAL COLLECTIVE LABOUR AGREEMENTS (CCNL) HAS BEEN PUBLISHED

The CNEL has published the Information Note on the filed National Collective Labour Agreements (CCNL), with reference to the period January-December 2023 and the first quarter of 2024.

As at 15 March 2024, the National Archive of Collective Labour Contracts and Agreements established at the CNEL shows that 202 National Collective Labour Agreements renewing or updating specific clauses had been signed during 2023, of 171 included National Collective Labour Agreements (private and public sectors) and collective economic agreements (for self-employment). 

Overall, as at 31 December 2023, 1033 National Collective Labour Agreements had been filed with the CNEL, of which 971 related to the private sector, 18 to the public sector and 44 collective economic agreements concerning certain categories of self-employed and para-subordinate workers. 

However, thanks to the Uniemens reports and the CNEL Code of National Collective Labour Agreements, it is possible to show that the 28 National Collective Labour Agreements in the private sector with application above 100,000 employees, although representing only 3.2% of the filed contracts, cover almost 11 million workers, or 78.8% of the employee workforce traceable in the Uniemens reports (excluding agriculture and domestic work). 

Looking at the Uniemens data, it emerges that the 99 National Labour Collective Agreements with application above 10,000 employees cover almost all employees in the private sector: 13,398,243 workers, or 96.9% of the private sector workforce tracked by Uniemens.

It should be highlighted that 645 National Collective Labour Agreements (equal to 72.7% of the contracts filed) apply to less than 500 employees and, in total, cover 0.3% of employees.

As for the signatories, it should be noted that of the 971 private sector National Collective Labour Agreements filed with CNEL on 31 December 2023:

- 210 National Collective Labour Agreements are signed by trade federations members of Italian General Confederation of Labour (Confederazione Generale Italiana del Lavoro, CGIL), Italian Confederation of Trades Unions (Confederazione Italiana Sindacati Lavoratori, CISL), Italian Labour Union (Unione Italiana del Lavoro, UIL) and apply to a total of 13,362,921 workers;

- 309 National Collective Labour Agreements are signed by trade unions not represented at CNEL and apply to only 49,561 workers;

- the remaining ones are signed by trade unions represented at CNEL but other than CGIL, CISL, UIL. 

Therefore, 96.5% of private sector workers are subject to a National Collective Labour Agreement signed by trade federations belonging to CGIL, CISL, UIL.

“These data”, says the CNEL President Renato Brunetta, “as well as underlining the importance and richness of the CNEL's National Archive of Collective Agreements, on the whole highlight the good health of our industrial relations system with a generalised application of collective agreements, even in the absence of a trade union law, and with contractual dynamics still largely governed by confederal trade unions. There is undoubtedly an increase in the number of filed contracts - and this phenomenon must be carefully monitored - but, looking at the magnitude in terms of workers to whom these contracts actually apply, it is possible to affirm that there are 100 main National Collective Labour Agreements in Italy, meaning that they regulate, on the whole, almost all labour relations in the private sector”.
